LEGAL GUARANTEE FOR OUR CONSUMER

1. The products offered on the Site are compliant with the applicable standards in Italy. SKUDOMADE.IT S.r.l. respects and protects the consumer in terms of legal guarantee of conformity and is liable for any defect that occurs within two years from the delivery of the goods pursuant to art. 130 of the Consumer Code.
2. For the purposes of exercising the right, it is assumed that the consumer goods comply with the contract if:
   • the product has the characteristics usually present for goods of the same type;
   • the goods conform to the description given by the seller and possess the qualities that the seller has already presented to the consumer in sampling or model;
   • the goods have the qualities that the consumer can reasonably expect, given the nature of the goods and, where appropriate, the declarations made in this regard by the seller with advertising media, sponsors and information forms, by the producer or his agent or representative, also in particular on labeling;
   • the products are suitable for the particular use desired by the consumer, in accordance with what is presented to him at the time of purchase, if brought to the attention of the seller at the time of conclusion of the contract, accepted by the latter also for concluding facts

1. The following defects are not included in the concept of “conformity defects”:

1. • personal comfort preferences in the wearer;
   • damage caused by cuts, burns, cuts, liquids or stains due to customer actions;
   • usury;
   • loss of closing buttons;
   • rupture of hinges during use that are caused by mechanical jamming;

In accordance with art. 132 of the Consumer Code, the buyer loses all rights if he does not report the lack of conformity to the seller within two months from the date on which the defect was discovered. To this end, the consumer must send the communication in writing to the address: SKUDOMADE.IT S.r.l. , Corso Siccardi 11 bis, 10122 Turin (TO), Italy or by email to: customercare@skudomade.it.
2. In any case, unless proven otherwise, it is assumed that the lack of conformity that occurs within six months of delivery of the goods already existed on the delivery date.
3. In order to take advantage of the legal guarantee, the consumer must provide proof of delivery of the same by the company, keeping the purchase invoice, or any other document that can certify the date of the purchase (for example the account statement credit card) and the date of delivery.
4. In the event of ascertained conformity defect falling within the definition of it as given in paragraph 2, the purchaser may request in accordance with art. 130 of the Consumer Code, alternatively, without ever incurring additional expenses, the repair or replacement of the purchased item, a reduction in the purchase price or termination of this contract, unless the request is objectively impossible to satisfy or results for the company SKUDOMADE.IT S.r.l. excessively burdensome.
5. Once the request has been submitted, the company SKUDOMADE.IT S.r.l. will answer the consumer within seven working days of receipt, indicating his willingness to proceed with the request, or the reasons that prevent him from doing so.
6. If SKUDOMADE.IT S.r.l. decides to accept the consumer’s request, our company must indicate the method of delivery or return of the goods as well as the deadline for the return or replacement of the defective goods, at no cost to the buyer (in Italy).
7. 10.If the repair and replacement are impossible or excessively expensive, or the Company SKUDOMADE.IT S.r.l. has not repaired or replaced the goods within the time limit referred to in the previous point or, finally, the replacement or repair previously carried out caused significant inconvenience to the purchaser, who may request, at his option, a reasonable price reduction or termination of the contract. In this case, the purchaser must send his request to the company SKUDOMADE.IT S.r.l., which within the next seven working days from the receipt, will indicate its willingness to carry out the same, or the reasons that prevent it from doing so.
8. 11.If the company SKUDOMADE.IT S.r.l. accepts the request of the Buyer, must indicate the reduction of the proposed price or the methods of returning the defective goods against the total refund of the amount paid, for the re-credit of which the consumer will indicate the operating procedures.
